As of 2026-07-27, DWR Water Rights Net Amounts. The state records WDID 0301142 under the name Mail Creek Ditch. The 93 cfs right there is a New Mercer Ditch Company right: it was decreed in the company's supplemental adjudication of September 10, 1953 (Larimer County Case No. 11217), and the state's own record for that right lists case numbers 05CW0323, 92CW0129 and CA11217. An abandonment decree entered December 26, 1985 by the District Court, Water Division 1, in Case No. 84CW663 declared 85.53 cfs of the company's February 15, 1880 right (Case No. 320) partially abandoned. The state today records that 1880 right at 50.47 cfs on WDID 0300913. Absolute rights are decreed for water already put to use; conditional rights hold a place in line for use not yet completed. Amounts are shown exactly as the state records them. How this page is built.

Water-right lineage

This timeline puts this company’s decreed rights across all 3 structures listed above in chronological order by appropriation date (oldest first), grouped by decade; each entry names the structure (WDID) it belongs to. It reflects DWR’s current net-amounts tabulation, not a complete decree history: intermediate decrees, changes, and abandonment proceedings exist only in the underlying court case files. It is not a title opinion and not a complete chain of title.

34 additional rights recorded only as alternate-point/exchange (APEX) net amounts are not included in this timeline.

A mutual ditch or reservoir company is a nonprofit corporation formed under Colorado law — most commonly C.R.S. Title 7, Article 42 — so that landowners who share an irrigation ditch, canal, or reservoir can jointly own and operate it. Instead of the water right belonging to a single person, shares in the company represent each owner's proportional claim, and the company's board and secretary keep the ledger, run assessments for maintenance, and issue certificates the way any small corporation would. Many of these companies have operated continuously since the 1880s, run entirely by volunteer officers who inherit the books from whoever kept them before.

Buying or selling land with shares in New Mercer Ditch Company?

Ditch shares are corporate stock — they don't transfer with the deed, and under C.R.S. § 7-42-104 unpaid assessments follow the shares to the new owner as a lien. The plain-English walkthrough — including what the standard Colorado contract does and doesn't protect — is at Ditch shares at closing on Water Rights Colorado, a guide site from DitchBook's operator.
